With all the water we have experienced in Henderson County, many of us may have to make insurance claims for damages we sustain. I’m sure most of us would be shocked to know that damage to our homes caused by water may not be covered by the insurance policy. Water considered as flooding is more than likely not covered.
What’s interesting in Texas is that wind damage is covered by a standard homeowner’s insurance policy. Flood water not covered, wind covered? How do you decide? Well, the insurance company has the burden to prove what caused the damage to deny a claim. What if both caused the damages? Another really interesting dilemma. The wind may cause a problem that allows water to then cause additional damage. Confused yet? It is confusing.
Ultimately, the facts of each loss are going to dictate whether there is insurance coverage or not. Don’t be offended if the insurance company denies the claim. It is easy for the insurance company to just deny. However, to deny the claim, the insurance company will have to properly document their file. You might also want to consult with a lawyer or public adjuster before giving a statement to your insurance company. Remember anything you say can and will be used against you. Please use your best judgment before speaking to the insurance company. If you use a word like water or flooding and it was really the wind that caused the initial problem you are going to give the insurance company the ammunition they need to properly deny your claim.
